1.בעתירה שלפנינו, שנוסחה על ידי המערער, מתבקש צו על תנאי – בגדרו על המשיב 1 לבוא ולהראות טעם מדוע לא יוכל העותר להגיש בקשת רשות ערעור, שעד כה לא התאפשר לו להגישה עקב דחיית בקשתו להארכת מועד להגשתה בבית משפט זה. כן נתבקשנו על ידי העותר להורות על שליחתו לבדיקה פסיכיאטרית, שתוצאותיה יוכלו, לדעתו, להשפיע על בקשת רשות הערעור האמורה, באם נאפשר הגשתה.
2.לאחר בחינת טענות העותר הגענו לכלל מסקנה כי עתירה זו – דינה להדחות על הסף. להלן תובא בקצרה ההנמקה לתוצאה זו.
3.בקשת רשות הערעור בה מדובר היא כנגד פסק-דינו של בית המשפט המחוזי בתל-אביב-יפו בע"א 1466/09 (שבמסגרתו נדחה ערעור שהגיש העותר על פסק-דינו של בית משפט השלום בתל-אביב-יפו, שדחה על הסף את תביעת העותר נגד בנק הפועלים בע"מ – המשיב מס' 2; להלן גם - הבנק).
4.הרשם של בית משפט זה (כב' השופט ג' שני) דחה את בקשת העותר להארכת מועד לצורך הגשת רשות הערעור הנ"ל מאחר שלא שוכנע בקיום "טעם מיוחד" למתן הארכה המבוקשת, ותוך מתן משקל נכבד לציפיותיו של הבנק לסופיות ההליכים (בש"א 3112/12). ערעור על החלטת הרשם, שהוגש לבית משפט זה – במסגרת בש"א 3706/12 – נדחה על ידי חברי, השופט ס' ג'ובראן, אשר קבע כי העותר לא הציג בערעורו "טעם המצדיק התערבות בהחלטת הרשם", וכי אף לטעמו "לא הציג [העותר – תוספת שלי – ח"מ] טעם, אשר יש בו כדי להוות טעם מוצדק להיענות לבקשתו להארכת מועד".
העותר הגיש בקשה לעיון חוזר בפסק דינו של בית משפט זה ב-בש"א 3706/12 הנ"ל ואף זו נדחתה על ידי בית משפט זה.
5.לפנינו איפוא נסיון נוסף של העותר להעמיד לבחינה משפטית את הסוגיה שנדונה מכל צדדיה, כאמור בפיסקה 4 שלעיל, תוך מיצוי כל ההליכים האפשריים בפני בית משפט זה. נסיון זה איננו קביל לאור הכלל הידוע לפיו:
"בית משפט זה בשבתו כבית משפט גבוה לצדק – איננו יושב כערכאת ערעור נוספת על החלטות אחרות של בית משפט זה בשבתו כבית משפט לערעורים" (ראו: בג"ץ 3144/10 יעקב חיננזון נ' נשיאת בית המשפט העליון,כב' השופטת, דורית ביניש (לא פורסם, 27.4.2010), וההפניות שם).
יפה לעניין זה גם העקרון, המעוגן בסעיף 15(ד)(3) ל חוק יסוד: השפיטה, ושמכוחו נקבע כי בית משפט זה בשבתו כבית משפט גבוה לצדק – לא יתערב, ככלל, בהליכים המתנהלים בבתי המשפט הרגילים, אלא אם כן מוכחת טענה של חוסר סמכות מהותי, או אם מתגלית תופעה קיצונית של שרירות בתחום הנוגע במינהל-שיפוטי טהור (ראו לאחרונה: בג"ץ 4441/12 מייק ואן קול נ' מדינת ישראל (לא פורסם, 11.11.2012); עיינו גם: בג"ץ 583/87 הלפרין נ' מדינת ישראל, פ"ד מא(4) 683, 702 (1987); בג"ץ 7768/12 צ'רני נ' בית המשפט המחוזי בתל אביב-יפו (לא פורסם, 26.10.2012)).
המקרה שלפנינו איננו נכנס בגדר המקרים החריגים הנ"ל.
6.נוכח כל האמור לעיל – העתירה נדחית איפוא על הסף מחמת כך שאיננה מגלה עילה על פניה. עם זאת בשים לב למצוקתו האישית של העותר, הנלמדת מהעתירה, הננו ממליצים בפניו שיפנה לרשויות הרווחה, ללשכה לסיוע משפטי ולגורמים נוספים – לעזרה שהוא נדרש לה.
