2.אלו הן העובדות הצריכות לעניין: נגד העותרת ומשיבים 5-8 הוגש כתב אישום לבית המשפט השלום בכפר סבא. כתב האישום ייחס לעותרת עבירה של ביצוע שימוש טעון היתר ללא היתר, לפי סעיף 145 (א)(3); 204(א); 205; 208 לחוק התכנון והבנייה. משיבים 5-8 הואשמו בביצוע עבודה הטעונה היתר ללא היתר, לפי סעיף 145 (א)(1); 204(א); 205; 208 לחוק התכנון והבנייה. על פי הנטען בכתב האישום, ביום 24.4.2006, נחתם הסכם לריבוד כביש גישה קיים לקיבוץ ניר אליהו בין המועצה לבין חברת עינב החץ (1965) בע"מ. תוואי הכביש תוכנן לעבור בתוך תחומי הקיבוץ בתוואי דרך קיימת. בעקבות פנייה מטעם הקיבוץ, הוחלט בין סגן ראש המועצה לבין מזכיר הקיבוץ לשנות את תוואי הדרך המתוכנן ולסלול דרך העוקפת את הקיבוץ, בלא שניתן לכך היתר כדין. סגן ראש המועצה הורה למהנדסהּ להורות לקבלן לבצע עבודות סלילת הדרך בתוואי החדש. זאת, על אף שלא היה היתר כדין לביצוע העבודות בתוואי החדש. הדרך העוקפת, באורך של כ- 1000 מ' אכן נסללה בתוואי החדש על גבי מקרקעין אשר ייעודם חקלאי וללא היתר כדין. העבודות להתוויית הדרך וסלילתה נסתיימו והדרך נמסרה לאחריות המועצה בחודש פברואר 2007. עם סיום הסלילה, נעשה שימוש בדרך בכביש עוקף הקיבוץ.

3.עיקר טענות העותרת הוא כי העמדתה לדין נעשתה ללא הליך שימוע תקין וכראוי טרם הגשת כתב האישום, בניגוד להנחיות היועץ המשפטי לממשלה. היא מדגישה כי שיקולי העמדה לדין של רשות מקומית אינם זהים לשיקולי העמדה לדין של גופים לא שלטוניים. לאמור: הרציונל המתקיים ביחס להענקת חסינות למדינה בפני העמדה לדין, מתקיים אף בזעיר אנפין ביחס לרשויות מקומיות. האינטרס הציבורי לא עומד לבדו. במסגרת שיקולי העמדה לדין יש לשקול את ההיבטים המיוחדים הכרוכים בהעמדת רשות מקומית לדין- כך למשל, העובדה שהעמדתה לדין עלול לפגוע במעמדה כאוכפת את אותם דינים שהיא מואשמת בהפרתם או להביא לקיפאון בפעולתם של נבחריה. לגישתה, שקלול שיקולים אלו מוביל למסקנה כי אין מקום להעמיד אותה לדין שעה שהעמדתה לדין תוביל לנזק יותר מאשר תועלת. מדובר במקרה חד פעמי, נקודתי, שנמשך כחודש ימים בלבד והעבודות מושא כתב האישום כבר הוסרו. עוד ציינה, כי המקרים בהם עומדת רשות לדין פלילי הם ספורים ונדירים. זאת ייעשה רק כאשר אין אמצעי מידתי יותר המגשים את המטרה המבוקשת. אולם ככלל, העמדה לדין של רשות מקומית כפופה למיצוי הליך מנהלי. זאת ועוד. במקרה דנא, נפלו בתהליך קבלת ההחלטות על העמדה לדין שורה של פגמים.

לדוגמה, לא נתקבל אישור מתאים להגשת כתב אישום וכן השימוע כאמור התקיים בדיעבד ולא לפני הגשת כתב אישום.

4.לאחר שעיינו בעתירה ובנספחיה, הגענו למסקנה כי דין העתירה להידחות על הסף.

היקף ההתערבות של בית המשפט הגבוה לצדק בשיקול דעת רשויות התביעה בענייני העמדה לדין הוא מצומצם (ראו בג"ץ 2419/06 שוורץ נ' היועץ המשפטי לממשלה (25.6.2006); בג"ץ 5091/03 תורק נ' היועץ המשפטי לממשלה, פ"ד נז (5) 665). הלכה מקדמת דנא היא, שבית משפט זה לא יתערב כעניין שבשגרה בשיקול הדעת המסור לרשויות האכיפה, בכל הנוגע לניהולה של החקירה הפלילית וגיבוש המסקנות לצורך העמדה לדין. בית משפט זה אינו מחליף את שיקול הדעת שניתן לרשויות התביעה בשיקול דעתו שלו, ורק החלטה אשר נמצאה לוקה בחוסר סבירות קיצוני, או בעיוות מהותי תצדיק התערבות שכזו (ראו בג"ץ 10034/05 בריל נ' מ"י (טרם פורסם). וכך נפסק:

"כידוע, בית משפט זה לא יתערב בהחלטותיו של היועץ המשפטי לממשלה בדבר העמדה לדין, אלא במקרים בהם נגועה ההחלטה בחוסר סבירות קיצוני הנובע מהיותה "לוקה בטעות ברורה, בולטת וקיצונית" (בלשונו של השופט ג' בך בבג"ץ 3425/94 גנור נ' היועץ המשפטי לממשלה ואח', פ"ד נ(4) 1, 10). אם כך הוא הדבר בהחלטות שעניינן אי-העמדה לדין – החלטות המייתרות את הצורך לקיים הליך פלילי- נכון הוא שבעתיים כשמדובר בהחלטה להעמיד אדם לדין, שבבסיסה הצורך לברר את דבר החשדות נגדו. בית-משפט זה לא ישים עצמו בנעלי הערכאה המוסמכת לבירור העניין, ולא יידרש לכל טענה שאך ברור הוא כי לעותרים עומדת הזכות להעלותה בפני הערכאה הדנה בעניינם" (ראו בג"ץ 10443/04 בכיראת נ' היועץ המשפטי לממשלה. תק-על 2004 (4)).

ההחלטה להעמיד לדין את המועצה אינה מסוג ההחלטות שיש מקום להתערב בהן. היא אינה נגועה בחוסר סבירות ובוודאי שלא חוסר סבירות קיצוני או בעיוות מהותי. העותרת טוענת כי בשל תפקידה כרשות אוכפת יש לבטל את כתב האישום, ולו למראית עין. זהו דווקא הטעם מדוע הגשת כתב אישום נגד רשות שהפרה את החוק אותו היא נלחמת ליישם- הכרחית היא, ולו מבחינת מראית פני הצדק. התשתית העובדתית, כפי שהוצגה בעתירה, אינה מקימה עילה להתערבות בית משפט זה בהחלטת רשויות התביעה.

טענות העותרת נגד תקינות ההליך מתחלקות לשני נימוקים בעניין השימוע. האחד, עניינו עריכת השימוע, לרבות קבלת אישור היועץ המשפטי לממשלה להגשת כתב האישום. נטען כי הן השימוע והן האישור נערכו בדיעבד ולא מלכתחילה. האחר, עניינו זהות שומע ההליך הנדון- מנהל המחלקה לאכיפת דיני מקרקעין בפרקליטות המדינה. בית משפט זה קבע זה מכבר כי טענות כגון דא ראוי להעלותן בפני הערכאה הדנה בכתב האישום לגופו. כפי שנפסק:

"באשר לסוגיית העברת חומר חקירה ועצם הסמכות להגשת כתב אישום (ומכאן לעריכת שימוע) הרי שכפי שהעותרים עצמם הסכימו בתגובתם מדובר בטענה שיש לטעון במסגרת ההליך הפלילי....הטענות העולות בעתירה, מרביתן ככולן, קשורות להליך הפלילי ואין מקום לדון בהם במסגרת עתירה לבית משפט זה. ודוק: מעיון בפסיקה אנו למדים כי טענות דומות אכן מגיעות לפתחו של בית המשפט העליון אך זאת בשבתו כבית משפט לערעורים פליליים ולא בשבתו כבית משפט גבוה לצדק (ראו, למשל, רע"פ 322/03 שלעיל; רע"פ 10/97 חג'בי נ' מ"י (ניתן ביום 9.4.1997); רע"פ 9321/03 אהרון נ' מ"י (ניתן ביום 18.8.2005))" (ראו בג"ץ 6136/06 פרי נ' היועמ"ש (10.9.2006)).

"דרך המלך להעלאת טענות כנגד הפגמים שנפלו בהגשת כתב אישום (כולל בשלב החקירה) הינה במסגרת ההליך הפלילי גופו" (ראו בג"ץ 9131/05 ניר עם כהן ירקות אגודה שיתופית חקלאית בע"מ נ' מדינת ישראל/משרד התעשייה המסחר והתעסוקה (6.2.2006) והפסיקה שהובאה שם). הנה כי כן, אין מקום שבית משפט זה יתערב בהחלטה להעמיד לדין את העותרת. טענותיה בדבר קיומם של פגמים שנפלו בדרך הגשת כתב האישום, מן הראוי שידונו בפני בית משפט השלום בפניו מתנהל ההליך.

5.דין העתירה להדחות על הסף מבלי שנתבקשה תגובה. אין צו להוצאות.
