פסק-דין

א. ענייננו באספקת מים לתושבי כפר בלתי מוכר, ולמעשה ברישום פסק הדין בע"א 9535/06 אבו מסאעד נ' נציב המים (2011), שבו נקבע כי "נגישות למקורות מים לצורך שימוש אנושי בסיסי נופלת בגדרי הזכות לקיום מינימלי בכבוד". פסק הדין קבע עוד, כי ניתן להתחשב בשיקולים של היות היישוב לא חוקי וקיום פתרונות אכלוס אחרים, גם באיזון לעניין החיבור למים. בתיק דנא קבע בית הדין למים (25.1.12) כי התושבים בהם מדובר, מעבר לקיום מרכז מים במרחק 8 ק"מ, יכולים לקבל גם מים מחיבור על שמו של מר פרהוד אבו אל-קיעאן, במרחק 4 ק"מ (בעניין אבו מסאעד אושר חיבור של 3.5 ק"מ).

ב. לטענת המערער אין לראות את הפרקטיקה של חיבור פרטי להבטחת נגישות למים כחוקית. לטענת המדינה יש לראות פרקטיקה זאת כהכרח לא יגונה בתנאים הקיימים, הן כיון שאספקת המים עצמה מובטחת, והן כדי שלא "לעבות" את אי החוקיות של הכפר על-ידי תוספת חיבור חדש. שמענו גם את נציגת הרשות הממשלתית למים וביוב, שתיארה את האפשרויות במקרה שחלילה יווצרו בעיות באספקת המים בחיבור הקיים. לדבריה, על פי הניסיון הדרך לטיפול היא בפניה לרשות, הבודקת את הנתונים ומחפשת פתרונות חלופיים (וכמובן על החלטותיה ניתן להשיג לבית הדין למים).

ג. סבורים אנו כי אין מקום להתערבותנו בהכרעתו של בית הדין קמא. הנושא הוא ראש וראשונה יישומי-מעשי, ולעניין זה המצב הקיים של האפשרות להתחבר באמצעות חיבורו של מר פרהוד אל-קיעאן (בנוסף למרכז מים מרוחק יותר או אכלוס במקום אחר), מאפשר את האספקה הנחוצה, נושא שעליו אין חולק. ככל שיתעוררו בעיות נוספות, פתוחה הדרך לפנות לרשות, שחזקה כי תאזין. בנתון לכך איננו נעתרים לערעור. איננו עושים צו להוצאות.
