פסק-דין

בהסכמת הצדדים (הודעת המערער מיום 12.9.2011 והודעת המשיב 1 מיום 2.11.2011) אני מורה על ביטול התוצאה האופרטיבית בפסק דינו של בית משפט קמא. המשיב 1 (התובע) יגיש תוך 60 יום תביעה לפיצויי הפקעה כנגד הועדה המקומית לתכנון ובניה ויהא זכאי לפיצוי שייפסק ע"י בית המשפט בתביעה שתוגש על ידו כאמור, בצירוף 20% נוספים מהסכום שייפסק, שישולמו לו ע"י המערער (מינהל מקרקעי ישראל). זאת, כפיצוי נוכח ההתרחשויות כמתואר בפסק דינו של בית משפט קמא, ולסילוק מלוא תביעותיו כנגד המינהל בגין כך.

בית המשפט רשם לפניו כי הסכמתו של המערער לפשרה, נעשתה לפנים משורת הדין נוכח הערכתו את גובה הפיצוי שייפסק בתביעה שתוגש, ולאור המלצת בית המשפט נוכח הנסיבות שנוצרו. המערער יהא רשאי לבקש להצטרף כצד לתביעה שיגיש המשיב 1, בהיותו צד שעלול להיפגע מתוצאות ההליך עקב הסכמתו לשלם 20% נוספים מסכום הפיצויים שייפסקו.

אין צו להוצאות. הפקדון שהופקד על ידי המשיב 1 בערעור שכנגד יוחזר.
