פסק-דין

1.ערעור על החלטת בית המשפט המחוזי מרכז-לוד (כבוד השופט א' יעקב, סגן נשיא), מיום 10.7.2014, בת"א 5786-08-07, לפיה נדחתה בקשת המערער כי בית המשפט יפסול עצמו מלהמשיך לדון בהליך המתנהל בעניינו.

2.המערער, שאינו מיוצג, הגיש תביעה לבית המשפט המחוזי מרכז-לוד לפצותו בגין נזקים, שנגרמו לו, לטענתו, "מרישומים פנימיים בתיקי סרק פליליים שהמשטרה ניסתה לתפור לו" (ת"א 5786-08-07). כמו כן, הגיש המערער עתירה מינהלית לבית המשפט המחוזי מרכז-לוד בגין ביטול רישיון הנשק שלו (עת"מ 44359-02-12). ביום 28.4.2014 ניתן פסק דין בעתירה המינהלית (כבוד השופט א' יעקב). בית המשפט דחה את העתירה וקבע כי זכותו של המערער לא קופחה, וכי ועדת הערר לעניין רישוי כלי ירייה שקלה את השיקולים הרלוונטיים תוך מתן משקל לטענות המערער. לפיכך, לא מצא בית המשפט לנכון להתערב בהחלטה המינהלית. על פסק הדין הגיש המערער ערעור לבית משפט זה, שעודנו תלוי ועומד (עע"ם 3792/14). התביעה האזרחית נדונה אף היא בפני כבוד השופט א' יעקב.

3.בעקבות מתן פסק הדין בעתירה המנהלית הגיש המערער "בקשה להעברת מותב", שהייתה, למעשה בקשת פסלות. בית המשפט דחה את בקשת הפסלות. בית המשפט קבע כי אכן דן בעתירה המינהלית שהגיש המערער, אך בפסק הדין דן אך ורק בטענות שעניינן בתחום המשפט המינהלי, כמו מתן זכות טיעון, ומשכך, אין חשש למשוא פנים בהליך האזרחי שהגיש המערער. בעקבות החלטה זו הגיש המערער את הערעור שלפניי.

4.המערער טוען כי משטרת חיפה "ניסתה לתפור" לו תיקים בשנות התשעים של המאה שעברה ומבהיר כי המשטרה חזרה בה מכתבי האישום. המערער מוסיף כי הגיש תביעה בגין הנזקים שנגרמו לו בעקבות התנהלות המשטרה הכוללים, בין היתר, אובדן כושר תעסוקה וביטול גיוסו למשטרה. המערער טוען גם כי "כחלק מנקמנות המשטרה" היא ביטלה את רישיון הנשק שלו "לאחר 33 שנה בהסתמך על רישום סרק פנימי חדש מ-2009...", ועל "רישומים פנימיים של תיקים סגורים", ולא ציינה כי לא הורשע בתיקים אלו. לגופו של עניין טוען המערער כי בית המשפט נהג במשוא פנים כלפיו בדיון בעתירה המינהלית שהגיש, סירב לדחות דיון שנקבע חרף מחלתו, ולא קיים דיון בבקשה שהגיש, חרף החלטה שנתן בעניין. בכך, טוען המערער, שלל בית המשפט את זכותו להליך הוגן ואת זכות הטיעון שלו. המערער מעלה השגות לגוף פסק הדין שניתן בעתירה המינהלית. לטענתו, בית המשפט נהג במשוא פנים כשאימץ את טענות המדינה. המערער מציין כי בפסק הדין קבע בית המשפט שצירף לעתירה משיבים רבים שאין להם קשר להחלטה המינהלית שתקף. לאור קביעה זו תוהה המערער כיצד ידון כעת בית המשפט בתביעה שבה תבע אישית שתי שופטות, פרקליטים וקציני משטרה. לדעת המערער, בהתחשב בתוכן פסק הדין בעתירה המינהלית דעתו של בית המשפט נעולה, ולכן אין בית המשפט יכול לדון עתה בתביעה האזרחית בנפש חפצה. המערער מוסיף כי הממצאים והקביעות בפסק הדין בעתירה המינהלית חופפים לאלו שבתביעה האזרחית, ואף מ דובר במשיבים דומים. מאחר שקיימת חפיפה ממשית בין הטענות ומ דובר באותם תיקים למעשה, יש, לדעת המערער, חשש ממשי למשוא פנים כלפיו ולכן מבוקש לפסול את בית המשפט.

5.דין הערעור להידחות. המערער לא הצביע על כל עילה המצדיקה את פסילת בית המשפט מלדון בתביעה האזרחית שהגיש, הגם שסיפור המעשה הבסיסי בשני ההליכים הינו אותו סיפור. כבר נכתב בעבר כי אין בעובדה שאותו שופט דן בהליכים קודמים הנוגעים לאותה פרשה עובדתית ומהווים המשך ישיר שלה כדי לשמש עילה לפסילת השופט. לפיכך, אין די בכך שבית המשפט דן בעבר בהליך דומה באותו עניין כדי להצדיק את פסילתו (למשל, ע"א 208/14 דיאמנט נ' שלמה נס, עו"ד (20.1.2014)). כמו כן, הבעת עמדה או דעה על ידי שופט במסגרת הליך אינה מקימה, בדרך כלל, חשש ממשי למשוא פנים, אפילו מ דובר באותו תיק ממש (יגאל מרזל דיני פסלות שופט 266-265 (2006)). אכן, במקרה דנא דן בית המשפט והכריע בעתירה המינהלית שהגיש המערער (וכאמור על פסק הדין שניתן הגיש המערער ערעור) ובפני אותו שופט קבוע ההליך האזרחי שהגיש המערער. ואולם, מ דובר כאמור בהליך מינהלי שהסתיים, ואילו התביעה הנדונה כעת היא תביעה נזיקית (השוו: ע"א 3921/13 רוטמן נ' עו"ד ליאור מזור, המנהל המיוחד (4.7.2013), בו השופטת דנה כחלק מהרכב בהליך פלילי בעניינו של המערער ולאחר מכן בבקשת נושה להכריז עליו פושט רגל. ערעור הפסלות נדחה). מכל מקום, יש לזכור כי פסילת שופט מלשבת בדין אינה מעשה של מה בכך, ולכן אין די בעובדה שעל בית המשפט להכריע בעניין בו דן בעבר או בנגזרותיו, או הביע עמדה, כדי לגרום לפסילתו (למשל, ע"א 7137/12 עוקב נ' רשות המיסים (3.3.2013)). כדי להצליח בבקשת פסלות יש להראות כי מאותה החלטה מוקדמת, או מנסיבות אחרות, עולה חשש ממשי למשוא פנים. אין זה המקרה דנא. המערער לא הצביע על בסיס כלשהו לחשש אובייקטיבי למשוא פניו כלפיו. כאמור, משלא קמה כל עילת פסלות, דין הערעור להידחות.

הערעור נדחה. משלא הוגשה תשובה אין צו להוצאות.
