השופטת א' חיות:

לאחר ששקלנו את טענות הצדדים ומתוקף הסכמתם כי הערעור יוכרע על דרך הפשרה כמפורט בהחלטתנו מיום 2.3.2011, אנו מורים כי המערערים ביחד ולחוד ישלמו למשיבים 3 סך כולל של 110,000 ש"ח. סכום זה יועבר לידי המשיבים 3 ישירות על ידי המשיבים 5, וינוכה מתוך הסכום שבו חויבו משיבים אלה כלפי המערערים בפסק דינו של בית המשפט המחוזי (השופטת א' גבאי) בת"א (ירושלים) 9271/07 מיום 5.5.2010. לצורך כך וכמפורט בהחלטתנו מיום 2.3.2011 יופקד הסכום של 110,000 ש"ח על-ידי המשיבים 5 בידיו הנאמנות של עו"ד שלום פוריס בתוך 30 ימים מהיום. הסכום יושקע על ידי עו"ד פוריס בהתאם להוראות שיקבל לעניין זה מעו"ד זרצקי באת-כוח המשיבים 3 והוא יועבר על ידו למשיבים 3 באמצעות עורך הדין זרצקי, על פירותיו, מיד עם השלמת רישום הבעלות בדירה נשוא הערעור על שם המשיבים 5.

אין צו להוצאות בערעור.
