עניינה של העתירה שלפנינו בבקשת העותרים, כי נורה למשיב ליתן טעם מדוע נשללה מהעותר 1 אזרחותו הישראלית, וכן ליתן צו המורה למשיב להחזיר לו את אזרחותו אשר ניתנה לו על ידי המשיב. במסגרת העתירה מבקשים העותרים צו ביניים, לפיו ייאסר על המשיב לגרש את העותר 1 מישראל עד למתן הכרעה בעתירה.

כפי שעולה מהעתירה, העותר 1 והעותרת 2, שאביה הינו יהודי, נישאו ברוסיה ביום 25.8.2003. השניים עלו ארצה בשנת 2005, קיבלו אזרחות ישראלית והחלו לבנות את מרכז חייהם בישראל. ברם, בעתירה מפורט כי העותר 1 חלה במחלת כבד קשה ונזקק לטיפולים מיוחדים אשר לא ניתן לקבל בישראל, ועל כן החל בטיפול חדשני בבית חולים אוניברסיטאי ברוסיה בשנת 2006. מאז, העותר 1 חי לסירוגין באילת, בה הוא מתפרנס, וברוסיה, בה הוא זוכה לטיפולים רפואיים. כאשר שהה באילת בחודש יוני 2008, הודע לו כי המשיב מתכוון לשלול את אזרחותו מאחר ואינו מתגורר בישראל. בפגישה שנערכה במשרדי המשיב נשאל מדוע העותרת 2 לא שוהה עמו בישראל והוא הסביר כי אינה יכולה לשאת בעלויות הנסיעה התכופות בין רוסיה לישראל. עם זאת, נציגי המשיב טענו כלפיו כי נישואיו לעותרת 2 פיקטיביים. בפגישה נוספת שנערכה במשרדי המשיב באילת הוחתם העותר 1 על טופס, אשר הוסבר לו כי הינו עוסק בהחזרת עולים דוברי רוסית לרוסיה. לטענת העותרים, המסמך עליו חתם העותר 1 מחוסר ידיעה, הינו מסמך בו הצהיר, לכאורה, כי נישואיו לעותרת 2 פיקטיביים, לצורך הדיון בשאלת שלילת אזרחותו. לעותר 1 לא ניתן עותק של המסמך עליו חתם.

לטענת העותרים, המשיב בחר להתעלם מכך כי העותר 1 הינו אזרח ותושב ישראל, אשר נמצא ברוסיה לתקופות לא מבוטלות אך לשם טיפולים רפואיים בלבד. המשיב בחר להתעלם גם מן העובדה שהעותרת 2 אינה מגיעה עימו לישראל משום שאין באפשרות בני הזוג לממן נסיעה משותפת לישראל, עקב עלויות הטיפול הגבוהות ברוסיה. בנוסף, העותרים גורסים כי המשיב חרג מסמכותו בהתנהלותו מול העותר 1, עת לא הועברה לידיו החלטת המשיב בעניינו, ופרטיה אינם ידועים.

המשיב מנגד, מציין בעתירתו כי לאחרונה אכן עלו חשדות כי מעמדו של העותר 1 כאזרח הושג במרמה, ולמעשה אינו מתגורר בישראל. לשם כך זומן לבירור בלשכת מנהל האוכלוסין באילת ביום 19.5.2008. עם זאת, הוא מציין כי טרם התקבלה החלטה בעניינו, ומעמדו כאזרח ישראל לא השתנה לעת הזו. משכך טוען הוא כי דין העתירה להידחות על הסף בהיותה עתירה מוקדמת. עוד טוען המשיב כי אף לו החליט זה מכבר בעניינו של העותר 1, הרי שדין העתירה להידחות בשל קיומו של סעד חלופי, בדמות פנייה לבית המשפט לעניינים מנהליים.

לאחר עיון בעתירה ובתגובת המשיב, מצאתי כי דין העתירה להידחות על הסף.

המשיב הבהיר בתגובתו כי טרם נתקבלה החלטה בעניינו של העותר 1. משכך, באין קיומה של החלטה מנהלית סופית, כל שכן בהיעדרה של החלטה כלשהי בעניינו, אין מקום לקיום ביקורת שיפוטית על ידי בית משפט זה (בג"צ 2467/07 התנועה להגינות שלטונית נ' ועדת הכנסת (לא פורסם, 18.3.2007); בג"צ 5222/07 עיריית חולון נ' שר הפנים (לא פורסם, 16.7.2007); בג"צ 6077/08 עו"ד אורית דן נ' נציב שירות בתי הסוהר (לא פורסם, 5.8.2008)).

מעבר לנדרש יצוין, כי לאחר שתתקבל החלטה בעניינו של העותר 1, יוכלו העותרים לפנות – אם יחפצו בכך – לבית המשפט לעניינים מנהליים, אשר בסמכותו לדון בעתירות הנוגעות לשלילת אזרחות לפי סעיף 11(ב) לחוק האזרחות, התשי"ב-1952.

אשר על כן, דין העתירה להידחות על הסף.
