השופט ס' ג'ובראן:

עניינה של העתירה שבפנינו בבקשת העותר, כי נורה למשיבים ליתן טעם מדוע לא תבוטל, או למצער תנומק, החלטתם שלא להעניק לו היתר כניסה לישראל, וכן ליתן טעם מדוע לא יונפק לו כרטיס מגנטי, כחלק ממתן היתר הכניסה כאמור.

העותר הינו אזרח הרשות הפלסטינית, תושב בית לחם. לטענתו, בשנת 2002 לא קיבל היתר כניסה לישראל מטעמים ביטחוניים ונמנעה יציאתו לחוץ לארץ. בעקבות פנייתו לרשויות הוסרה המניעה לצאת לחוץ לארץ, אך המניעה הביטחונית להיכנס לישראל נותרה בעינה, לאחר שסירב – לגרסתו – לשתף פעולה עם שירות הביטחון הכללי. ביום 15.3.2009 פנה למינהל האזרחי באזור יהודה ושומרון בבקשה לביטול המניעה הביטחונית ועריכת תחקיר ביטחוני חדש אודותיו. ביום 23.3.2009 נענה כי יוכל לבקש שתוסר המניעה הביטחונית עם הגשת בקשה למתן היתר כניסה לישראל לשם תעסוקה או מסחר. לטענתו, בפנייה שערך למשרד התיאום והקישור סירבו לקבל בקשה מעין זו.

לטענת העותר, על הרשות המנהלית לערוך לו שימוע בטרם תחליט כי קיימת בעניינו מניעה ביטחונית. לדידו, בהיעדרו של הליך זה, דין החלטת הרשות להתבטל. זאת ועוד, לגרסתו ההחלטה לסרב לבקשתו בת מספר שנים, ועל כן אינה מבוססת, אם בכלל, על מידע עדכני. מכאן עולה כי הרשות השלטונית לא הפעילה שיקול דעת ממשי בעת שקילת בקשתו ועל כן לא יצאה ידי חובתה. העותר מוסיף וטוען כי ההחלטות בעניינו נגועות בשיקולים זרים, חוסר סבירות ואפליה פסולה.

לאחר עיון בעתירה ובתגובת המשיבים, מצאתי כי דין העתירה להידחות על הסף, זאת בשל קיומו של סעד חלופי. הסעד המבוקש על ידי העותר הינו כי יינתן לו היתר שהיה בישראל. לפי סעיף 2 לחוק האזרחות והכניסה לישראל (הוראת שעה), התשס"ג-2003 (להלן: חוק האזרחות והכניסה לישראל (הוראת שעה)), לא יינתן אישור כזה לבאים מאזור יהודה, שומרון וחבל עזה, אלא לפי שיקול דעתו של המפקד הצבאי, על בסיס אחת העילות המנויות בסעיף 3ב לחוק האמור. בד בבד, נוסחו המתוקן של סעיף 12(3) לתוספת הראשונה לחוק בתי משפט לעניינים מנהליים, התש"ס-2000, מסמיך את בתי המשפט המנהליים לדון בעתירות מנהליות שעניינן החלטות רשות לפי חוק האזרחות והכניסה לישראל (הוראת שעה). משקיימת ערכאה שיפוטית המוסכמת לדון בבקשת העותר למתן היתר כניסה לישראל, לא ייעתר בית משפט זה לבקשתו (ראו בג"צ 4487/08 עמותת רופאים לזכויות אדם נ' מפקד כוחות צה"ל בעזה אלוף פיקוד דרום (לא פורסם, 4.9.2008); בג"צ 3397/08 איסמעיל נ' המפקד הצבאי לאזור הגדה המערבית (לא פורסם, 30.4.2009) (להלן: פרשת איסמעיל)).

אמנם, סמכותם של בתי המשפט המנהליים לדון בעתירות מנהליות איננה גורעת מסמכותו של בית משפט זה. עם זאת, עמד על כך חברי השופט גרוניס כי:

"רק במקרים חריגים ונדירים ביותר ייזקק בית משפט זה לעתירות בנושאים המצויים בסמכותו של בית המשפט לענינים מינהליים. הטעם לכך הוא, בין היתר, כי פסק דינו של בית המשפט לענינים מינהליים בעתירה מינהלית נתון ממילא לערעור בפני בית משפט זה בשבתו כבית משפט לערעורים." (בג"צ 2371/04 וולף נ' רשות שדות התעופה בישראל (לא פורסם, 14.3.2004); פרשת איסמעיל).

המקרה שבפנינו איננו נמנה על אותם מקרים חריגים המצדיקים את התערבות בית משפט זה בשלב זה. לעותר פתוחה הדרך לעתור ל בית המשפט לעניינים מנהליים בכדי להשיג על החלטות המשיבים בעניינו.

אשר על כן, דין העתירה להידחות על הסף.
