השופטת א' חיות:

1.תאיר ראדה, ביתם של העותרים (להלן: המנוחה), נרצחה ביום 6.12.2006 בבית הספר בו למדה. מספר ימים לאחר מכן נעצר בחשד לרצח רומן זדורוב אשר הודה במעשה ושיחזר אותו ובעקבות כך הוגש נגדו כתב אישום לבית המשפט המחוזי בנצרת (ת.פ.ח 502/07). ביום 18.3.2007, חודשיים לאחר הגשת כתב האישום, פנו העותרים אל המשיב במכתב שכותרתו "ערר על החלטה שלא להמשיך לחקור בפרשת רצח תאיר ראדה", אשר הוגש, על-פי האמור בו, מכוח סעיף 64(א) לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982 (להלן: חוק סדר הדין הפלילי). במכתבו מיום 25.3.2007 השיב המשיב לעותרים כי זכות הערר מכוח סעיף 64 לחוק סדר הדין הפלילי אינה נתונה להם שכן התקיימה בעניין חקירה שבסופה הוחלט על הגשת אישום. עוד ציין המשיב כי המסלול להשגה על התנהלות החקירה וההחלטות שנתקבלו במהלכה הינו במסגרת ההליך הפלילי בו מתבררת אשמתו של הנאשם בפרשה.

בעקבות כך הוגשה ביום 1.4.2007 העתירה שבפנינו.

2.בעתירה ובתוספת לעתירה שהוגשה ביום 29.4.2007 (להלן יחד - העתירה), מבקשים העותרים כי נורה על פתיחתה מחדש של החקירה בפרשה. לטענתם, לא נבדקו כראוי כל כיווני החקירה ואלו שנבדקו לא מוצו עד תום או נזנחו. בעתירתם סוקרים העותרים מסכת ארוכה ומפורטת של ממצאים ראייתיים מתוך תיק החקירה שהועמד לעיונם, שיש בהם לשיטתם כדי לבסס את המסקנה שהחקירה בפרשה לא התנהלה כראוי וכי נפלה טעות בקביעת זהות הרוצח. עוד טוענים העותרים כי המקרה נופל בגדר אותם מקרים המצדיקים את התערבותו של בית משפט זה, שכן שיקול דעתן של רשויות התביעה נגוע בחוסר סבירות קיצוני. לבסוף טוענים העותרים כי הודעת המשיב לפיה אין באפשרותם להגיש ערר מכוח סעיף 64 לחוק סדר הדין הפלילי אינה מבוססת מבחינה משפטית ויש לבטלה.

3.המשיב בתגובתו המפורטת טוען מנגד כי יש לדחות את העתירה בהעדר עילה להתערבות. המשיב מוסיף וטוען כי החקירה בפרשה זו היתה יסודית מאין כמותה וכללה, בין היתר, גביית הודעות ממאות עדים, תשאול של מאות אנשים, תפיסה ובדיקה של מאות מוצגים ועריכת מחקרי תקשורת ומחשב. לבסוף טוען המשיב כי נוכח החקירה שבוצעה ונוכח כתב האישום שהוגש בפרשה ברי כי אין מדובר ב"החלטה שלא לחקור או שלא להעמיד לדין", בה עוסק סעיף 64(א)לחוק סדר הדין הפלילי וממילא לא קמה לעותרים זכות ערר מכוחו.

4.דין העתירה להדחות על הסף. הלכה היא מלפנינו כי מידת התערבותו של בית משפט זה בשיקול דעתן של רשויות התביעה, ככל שהדבר נוגע לניהולה של החקירה הפלילית או להערכת הראיות וגיבוש המסקנות לצורך העמדה לדין, מצטמצמת לאותם מקרים נדירים שבהם לוקה פעולת הרשויות בחוסר סבירות קיצוני או בעיוות מהותי המצדיק זאת, וכדברי השופט מ' חשין בבג"ץ 4736/ 98 מעריב הוצאת מודיעין בע"מ נ' היועץ המשפטי לממשלה ואח', פ"ד נד(1) 659, 666:

אכן, אם על דרך הכלל לא ימהר בית - המשפט הגבוה לצדק להתערב בהחלטתו של היועץ המשפטי להעמיד לדין או שלא להעמיד לדין, ייאמרו דברים אלה בראש ובראשונה בשאלת הערכתן של ראיות, שאלה הניתנת במובהק להכרעתן של רשויות התביעה. רשויות התביעה קנו ידע, מקצועיות וניסיון רב, וחזקה עליהן כי תעשינה כמיטבן להעמיד לדין את מי שראוי כי יועמד לדין ושלא להעמיד לדין את מי שאין הוא ראוי כי יעמוד לדין. מרחב שיקול - הדעת של הפרקליטות, בעיקר בנושא זה, הינו מרחב רב, ובית - המשפט לא יתערב בהחלטתה אלא במקרים שבהם חרגה בְּיֶתֶר ממיתחם שיקול - הדעת אשר ניתן לה" (ראו גם: בג"ץ 8643/04 אורן נ' משטרת ישראל, תק על 2004(4) 2649 (2004); בג"ץ 10034/05 בריל נ' מ"י, תק על 2005(4) 2265 (2005); בג"ץ 3680/06 גואטה נ' פרקליטות מחוז מרכז, תק על 2006(3) 4072 (2006)).

לא מצאנו כי במקרה דנן יש בידי העותרים להצביע על פגם מהותי או על חריגה ביתר ממתחם שיקול הדעת המסור לרשויות התביעה, המקימים עילה להתערבותנו בהחלטותיהן. אדרבא, מתגובתו המקיפה והממצה של המשיב עולה כי הסוגיות שעלו בעתירה לא נעלמו מעיניהן ואף זכו להתייחסות ולמענה כנדרש. כך או כך ראוי הוא שסוגיות אלה, ככל שיש בהן להשפיע על בירור האמת בפרשה זו, תתלבנה ותתבררנה בד' אמותיו של ההליך הפלילי התלוי ועומד בבית המשפט המחוזי בנצרת. עמדתו של המשיב לעניין אי תחולתו של סעיף 64 לחוק סדר הדין הפלילי מקובלת עלינו אף היא וברי כי במקרה כמו זה שלפנינו בו התקיימה חקירה והוחלט על העמדה לדין, אין מקום לערר על-פי סעיף זה.

מכל הטעמים המפורטים לעיל, העתירה נדחית. אין צו להוצאות.
