עניינה של העתירה בבקשת העותר כי משיב 2 יקבל החלטה בתביעתו על פי חוק תגמולים לחיילים ולבני משפחותיהם (חבלה שלא בעת מילוי תפקיד) התשמ"ח-1988 (להלן – חוק התגמולים).

העותר, יליד 1985, התגייס לצה"ל בחודש מרץ 2004. ביום 17.10.05, בעת ששהה בחופשה, נפצע מקליעים שנורו לעבר הרכב בו ישב. המ דובר בארוע פלילי שאינו קשור לשירות הצבאי. מאחר שהעותר היה אותה עת חיל בשירות סדיר, נבחנה זכאותו על פי חוק התגמולים, המאפשר למי שעומד בתנאי החוק הכרה כנכה צה"ל גם אם נפגע שלא במסגרת מילוי התפקיד.

ביום 20.12.05 הגיש העותר תביעה לקצין התגמולים לצורך הכרה בנכותו. הטיפול התעכב עקב חקירה פלילית שהתנהלה בענין אירוע הירי, והמשיב המתין לתוצאות החקירה בשל האפשרות כי ייקבע שהעותר היה מעורב בארוע – ענין שהיה משליך במישרין על זכאותו.

ערעור שהגיש העותר לועדת הערעורים לפי חוק הנכים נמחק על פי בקשתו ביום 26.4.07.

ביום 5.7.07 נתקבלה החלטה בעניינו של העותר, לפיה החבלה שנגרמה לעותר בגין ארוע הירי הוכרה כחבלה בתקופת שירותו הצבאי.

לאור זאת, ניתנה הכרה במישור העקרוני לזכאותו של העותר לתגמולים מכח החוק, וזאת לאחר שהתברר כי על פי הנתונים נכון לעת זו אין ממצאים המעידים על מעורבותו באירוע הירי.

לאור האמור, הסעד שנתבקש בעתירה – לצוות על הרשות המוסמכת ליתן החלטה בתביעת העותר לפי חוק התגמולים התייתר.

דין העתירה להידחות.

בנסיבות הענין, אין מקום ליתן צו להוצאות.

ניתן היום, כ"ב באב תשס"ז (6.8.07).
