עתירה למתן צו על תנאי לפיו ינמק המשיב מדוע לא תבוטל החלטתו לבטל את אזרחותו הישראלית של העותר.

1.העותר נולד בברית המועצות לשעבר תחת השם ביביקוב אלכסנדר, ורכש זהות של יהודי בשם מקסים נסדקין (להלן: נסדקין), על מנת שיוכל להתחזות כנסדקין ולזכות באזרחות לפי חוק השבות, התש"י-1950 (להלן: חוק השבות). בשנת 1998 הגיע העותר לארץ בשם נסדקין, כאן הקים משפחה עם בת זוג עמה הוא מנהל משק בית משותף ונולדו להם שני ילדים.

בתחילת שנת 2009 נחקר העותר במשטרה והודה כי אכן עלה לארץ בזהות שאולה אותה רכש מנסדקין, ובעקבות כך הודע לעותר כי עניין ביטול אזרחותו בטיפול. ביום 23.3.2010 נמחק רישום העולה והאזרחות של נסדקין. ביום 11.5.2011 הודע לעותר על ידי משרד הפנים כי הוחלט למחוק את הרישום של נסדקין כעולה/אזרח ישראלי וכי לשם בחינת עניינו של העותר מטעמים אחרים, עליו לפנות תוך 30 יום ללשכת רשות האוכלוסין במקום מגוריו ולהגיש בקשה בצירוף פרטיו האמיתיים, מקוריים ומאומתים "ולחתום על כך כי ידוע לך שלא תהיה זכאי לקבלת אזרחות ישראלית בשום דרך וזאת מאחר ובעבר קיבלת מעמד בישראל בשל זהות שאולה וידיעות כוזבות".

מכאן העתירה שלפניי.

2.בעתירתו טוען העותר כי לפי סעיף 11 לחוק האזרחות, תשי"ב-1952 (להלן: חוק הכניסה לישראל), ניתן לבטל את אזרחותו שנרכשה בדרך כוזבת באחת משתי דרכים: אם טרם חלפו שלוש שנים מיום שנרכשה האזרחות – על ידי שר הפנים, ואם עברו למעלה משלוש שנים – על ידי בית המשפט לעניינים מנהליים (העותר בעתירתו מפנה לחוק הכניסה לישראל אך בגוף העתירה מצטט את סעיף 11 לחוק האזרחות ונראה שלכך כוונתו). לטענת העותר, בהתחשב בכך שחלפו למעלה מעשר שנים מאז שקיבל אזרחות, אין המשיב רשאי לבטל אזרחותו אלא באמצעות הליך ב בית המשפט לעניינים מינהליים.

3.לטענת המשיב יש לדחות את עתירת העותר על הסף ולגופה. זאת, מאחר שהמשיב לא ביטל את אזרחותו של העותר, אלא ביטל את אזרחותו של אותו נסדקין כעולה וכאזרח. לטענת המשיב, אין בענייננו תחולה לסעיף 11 לחוק האזרחות, באשר עסקינן במחיקת רישום מעמד עולה ואזרחות של אדם אחר, בשם נסדקין, שאינו העותר. לכן, אין יסוד לטענת העותר כי היה על המשיב לפנות ל בית המשפט לעניינים מינהליים על פי סעיף 11 לחוק האזרחות.

עוד טען המשיב כי העותר לא מיצה את ההליכים העומדים לרשותו, שכן לא הגיש בקשה לרשות האוכלוסין לשם בחינת עניינו מטעמים אחרים לשם קבלת מעמד אחר; ואף לא פנה ל בית המשפט לעניינים מינהליים טרם פנה ל בית משפט זה, בהתאם לסמכות הקבועה בסעיף 5 פריט 12 לתוספת הראשונה לחוק בתי משפט לעניינים מינהליים התש"ס-2000 (להלן: חוק בתי משפט לעניינים מינהליים).

4.טענת המשיב כי אזרחותו של נסדקין היא שבוטלה, ולא אזרחותו של העותר, אינה נקייה מספקות, שהרי עם ביטול אזרחותו של נסדקין, הפך העותר לחסר מעמד, כך שלמעשה, גם אם לא להלכה, בוטלה אזרחותו. לשאלה אם חל בענייננו סעיף 11 אם לאו, יש השלכה לעניין הסמכות העניינית, באשר תקיפת החלטתו של שר הפנים לבטל אזרחות שנרכשה על יסוד פרטים כוזבים היא בסמכותו של בג"ץ, אלא אם חלפו למעלה משלוש שנים ממועד רכישת האזרחות, ושר הפנים עצמו פונה בבקשה ל בית המשפט לעניינים מינהליים בבקשה לביטול האזרחות, כאמור בסעיף 11(ב(1) לחוק האזרחות. שאלה היא, מה הדין מקום בו שר הפנים לא פועל על פי הוראת סעיף זה – האם רשאי הנפגע לפנות ל בית המשפט לעניינים מינהליים או שמא תרופתו בבג"ץ, כפי שעשה העותר לאור טענתו כי סעיף 11 חל בעניינו כמי שאזרחותו-שלו בוטלה למעלה משלוש שנים לאחר קבלתה.

אותיר שאלה זו בצריך עיון, באשר נחה דעתי כי בכל מקרה, דין העתירה להידחות על הסף בשל אי מיצוי הליכים. במכתב משרד הפנים מיום 11.5.2011 נתבקש העותר לחזור ולפנות לרשות האוכלוסין לשם בחינת עניינו. ייכבד העותר ויפעל כאמור, ובהתאם להחלטה שתתקבל, יכלכל מעשיו בהמשך.

אשר על כן, העתירה נדחית על הסף.
