החלטה

1.עניינה של העתירה בבקשה להיתר כניסתם של העותרים 18-2 לישראל "במסגרת חוק השבות ו/או חוק הכניסה לישראל ו/או מטעמים הומניטאריים מיוחדים ו/או איחוד משפחות". בעתירה נטען כי העותר 1 הוא אביהם, דודם וסבם של יתר העותרים הזכאים להיכנס מכוחו. במסגרת העתירה ביקשו העותרים צו ביניים לפיו יתאפשר לעותרת מס' 9 גב' פטפט מוגס (להלן: העותרת), להיכנס לישראל לקבלת טיפולים רפואיים עוד טרם תתברר זכאותה לגופה. הן מאחר שחלק ממשפחתה, כולל שתי בנותיה, כבר עלו ארצה, והן על מנת לקבל בישראל טיפול רפואי בסרטן הלבלב בו לקתה, לטענתה. העותרת התחייבה לחזור לאתיופיה עם סיום הטיפול.

2.דין הבקשה להידחות, באשר הסעד של טיפול רפואי שנתבקש במסגרת צו הביניים אינו בא לשרת את הסעד העיקרי של קבלת אזרחות ישראלית (השוו רע"א 2561/10 זלכה נ' בנק לאומי למשכנתאות, סעיף 8 להחלטתו של השופט דנציגר (לא פורסם, 9.4.2010)).

מכל מקום, דין הבקשה להידחות בשל אי מיצוי הליכים. העותרת רשאית לפנות לרשות האוכלוסין וההגירה בבקשה לקבלת אשרת כניסה לישראל מכוח חוק הכניסה לישראל לצורך הטיפול הרפואי המתבקש, בצירוף המסמכים התומכים בבקשה. ככל שתידחה הבקשה, רשאית העותרת לעתור בנפרד בעניין זה ל בית המשפט לעניינים מינהליים ב סמכותו לפי סעיף 5 פריט 12(1) לתוספת הראשונה לחוק בתי משפט לעניינים מינהליים התש"ס-2000 (להלן: חוק בתי משפט לעניינים מינהליים).

3.אשר על כן, הבקשה נדחית.
