פסק-דין

בעקבות המלצתנו הודיע העותר כי אינו עומד על העתירה.

רואים אנו לנכון לציין כי מן החומר עולה שהעותר, אשר שימש כעוזרו של הרמטכ"ל גבי אשכנזי, נקלע למצב קשה, שלא לומר בלתי אפשרי, בעת שפעל בפרשה הידועה כפרשת הרפז. עסקינן בעתירה נגד דו"ח של מבקר המדינה בו נאמרו דברים בלתי מחמיאים לגבי העותר. היקף הביקורת של בית המשפט לגבי דו"ח כאמור הינו מצומצם ביותר. בית משפט זה אינו יושב כערכאת ערעור על דוחות של מבקר המדינה. העתירה מבקשת להופכנו לערכאת ערעור. על רקע זה באה המלצתנו לעותר.

העתירה נדחית בלא שייעשה צו להוצאות.

צו איסור הפרסום שניתן ביום 14.3.2013 יעמוד בעינו.
