השופט י' דנציגר:

עניינה של עתירה זו בהחלטת המשיבה 3 להעביר לאישור ממשלת ישראל את תכנית לתשתית לאומית 16 (להלן: תת"ל 16 או התכנית), ובהליך שקדם לקבלת החלטה זו. תת"ל 16 עוסקת בשדרוג קטעים מכביש מספר 1 המחבר בין תל-אביב לבין ירושלים.

עיקר טענתם של העותרים נוגע לחלקה של תת"ל 16 לפיו הירידה ליישוב מוצא מכיוון ירושלים תבוטל. לטענת העותרים, בחירת חלופה זו תפגע בשורה של זכויות יסוד של תושבים רבים, בעוד שחלופות אחרות תגרומנה לפגיעה מידתית יותר בזכויותיהם. בנוסף, טוענים העותרים כי החלטה המשיבה 3 התקבלה תוך בחינה שטחית של החלופה בה הם מצדדים ותוך שהמשיבה 3 נמנעה מלקבוע קביעות הכרחיות בנוגע לשלביות הביצוע ולאופן הביצוע. עוד נטען כי נפלו פגמים מהותיים בהליך התכנון שקדם להחלטת המשיבה 3, לרבות אי מתן זכות טיעון וביסוס ההחלטה על עובדות שגויות ומצגי שווא שהוצגו לפניה. בפרט טוענים העותרים כי היה על המשיבה 3 לזמן את המתכנן של החלופה הרצויה לדידם לדיון שהתקיים בפניה ושבו נבחנה חלופה זו, בעוד שבפועל הדיון בחלופה התקיים ללא שזה נכח.

בד בבד עם הגשת העתירה ביקשו העותרים כי יינתנו צווי ביניים עד להכרעה בעתירה ולפיהם ייאסר על המשיבה 2 לקדם את תת"ל 16 או להוציא אותה לפועל וכי ייאסר על המשיבה 8 לבצע כל עבודה מכוח התכנית בשטח או כל פעולה אחרת שיש בה כדי לקדם את התכנית.

בהתאם להחלטה מיום 19.10.2010, הגישו המשיבים את תגובותיהם. במסגרת תגובת המשיבים 5-1 הועלתה טענה מקדמית לפיה העתירה הינה מוקדמת מאחר שטרם הסתיים ההליך התכנוני שכן התכנית טרם אושרה על ידי ממשלת ישראל. נוכח טענה מקדמית זו התבקשו העותרים להודיע האם עומדים הם על עתירתם. בהודעתם מיום 24.2.2011 נמסר כי הם עומדים על עתירתם וכי הם אינם סבורים שיש צורך להמתין לאישור הממשלה לתכנית על מנת לדון בעתירה, שכן העתירה תוקפת את ההליך התכנוני שקדם להחלטה, הליך שנסתיים עם קבלת החלטת המשיבה 3 להעביר את התכנית לאישור הממשלה.

מקובלת עלינו עמדת המשיבים 5-1 לפיה העתירה מוקדמת. ההליכים לאישור תכנית לתשתית לאומית מוסדרים בסעיף 76ג לחוק התכנון והבניה, התשכ"ה-1965 (להלן: חוק התכנון והבניה). על פי הוראת סעיף 76ג, בהליכים לאישור תכנית לתשתית לאומית ינהגו לפי הוראות חוק התכנון והבניה העוסקות באישור תכנית מתאר ארצית, בכפוף למספר שינויים המפורטים בסעיף זה. אכן, אחת מאבני הדרך המרכזיות בהליכי תכנון תכנית לתשתית לאומית היא החלטת הועדה הארצית לתכנון ולבניה של תשתיות לאומיות האם להגיש תכנית לאישור הממשלה, אף החלטה זו אינה מסיימת את ההליך התכנוני, אלא החלטת ממשלת ישראל המאשרת את התכנית (ראו: סעיפים 53 ו-54 וכן הוראות סעיף 76ג(9)(ב) ו-76ג(10) לחוק התכנון והבניה).

ממשלת ישראל טרם אישרה את תת"ל 16 ועל כן לא ניתן לומר כי ההליך התכנוני באשר לתת"ל 16 הסתיים וכי לפנינו החלטה סופית [ראו והשוו: ע"א 2902/97 אחים עופר הנדסה ופיתוח בע"מ נ' גליקמן, פ"ד נג(1) 369, 379 (1999); עע"ם 3189/09 החברה להגנת הטבע נ' המועצה הארצית לתכנון ולבניה (לא פורסם, 2.7.2009), פסקה 25 לפסק הדין; בג"ץ 3881/10 התאחדות המלונות בים המלח נ' מדינת ישראל (לא פורסם, 29.7.2010)].

משאלו פני הדברים, העתירה שלפנינו מוקדמת. נעיר כי אין באותם המקרים אליהם הפנו העותרים בהודעתם מיום 24.2.2011 כדי לשנות מן המסקנה אליה הגענו ולו מן הטעם כי באותם המקרים לא הועלתה טענה לפיה העתירה מוקדמת.

אשר על כן, אנו מורים על מחיקת העתירה. למותר לציין כי אין בהחלטתנו זו כדי לקבוע דבר לגופו של עניין ולעותרים האפשרות לשוב ולהעלות את טענותיהם לאחר שתתקבל החלטת הממשלה לאשר את התכנית, ככל שהחלטה כאמור תתקבל.

בנסיבות העניין, אין צו להוצאות.
