פסק-דין
1.בשני הערעורים שבפנינו משיגים המערערים על פסק-דין של בית המשפט המחוזי בתל-אביב-יפו (כבוד השופטת י' שבח). בפסק-הדין חוייב כל אחד משני המערערים לשלם למשיב 1 (להלן – המשיב) סכום של 814,784 ש"ח בצירוף ריבית והפרשי הצמדה. המערערים טוענים כי לא היה מקום להשית עליהם את החיוב הכספי.
2.השלושה, שני המערערים והמשיב, ואדם נוסף הקימו שותפות שעסקה בגידולם של עצי דקל ננסיים ומכירתם. בשלב מסוים הקימו הארבעה חברה, אליה העבירו את עסקה של השותפות. המשיב הוא שמימן את העסק ואף המציא בטוחות לבנק שבו התנהל חשבונו של העסק. כל אחד מהארבעה חתם על ערבות לטובת הבנק לעניין חשבון העסק. בסופו של דבר נאלץ המשיב לשאת בחוב לבנק. תביעתו הייתה תביעת השתתפות נגד האחרים, שכאמור אף כל אחד מהם חתם על ערבות לבנק. אחד מן השלושה, המשיב 3, פשט את הרגל ולכן יצא מן התמונה.
3.הטענה העיקרית של המערערים היא כי המשיב משך סכום כסף מסוים מחשבון החברה וכי סכום זה היה בגדר החזר ההשקעה של המשיב, ולכן אין הוא זכאי להשתתפות. בית משפט קמא לא קיבל את הטענה אלא מצא כי מ דובר בהחזר הלוואה שלקח המשיב לצורכי העסק. ההשגה של המערערים אינה יכולה להתקבל ולוּ בשל כך שמ דובר בממצא עובדתי שנקבע על ידי הערכאה הדיונית שאין זה מדרכה של ערכאת הערעור להתערב בה. לא שוכנענו מטענות המערערים כי יש לסטות מן הכלל במקרה זה.
4.הערעור נדחה. כל אחד מן המערערים יישא בשכר טרחה בסך 30,000 ש"ח לטובת המשיב 1.
